BY ACCESSING OR PARTICIPATING IN THE BARNS LOYALTY PROGRAM, YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS: -

You acknowledge and agree that the electronic format of these terms of use does not, in any way, affect their validity or enforceability. Your access to or participation in Barns Loyalty Program is subject to all applicable laws.

PRIVACY STATEMENT
Our Privacy Statement is incorporated into these terms of use and also governs your participation in Barns Loyalty Program. Please read the Privacy Statement carefully to understand how we collect, use and disclose information about you, how to update or change the personal information you have provided to us, and how we communicate with you.
Barns Loyalty Program
It is a program whereby individual customers can earn points by purchasing from Barns branches and kiosks. The program aims to encourage customers to continue dealing with the company and increase sales volume, by providing benefits and rewards that motivate them to make frequent purchases and always remain customers of the company. Any customer has the right to register in the loyalty program in all regions of the Kingdom of Saudi Arabia.
JOINING Barns Loyalty Program
To join Barns Loyalty Program, go to ……………………. (the “Website”), or to the Barns mobile app (“App”) and follow the prompts to create an account. You will be required to provide the following information and follow the prompts to create an account. You will be required to provide the following information:
1. First and last name, email address and password.
2. Birthday (month, day) is optional to receive birthday offers. If you do not provide birthday information you will not receive your Birthday Reward.
3. Preferred language for email communications from Barns.
When you join Barns Loyalty Program via the App,
-you will be provided with a unique tier code, this code will be displayed as a QR code in the App, which can be scanned in store to collect Points and Rewards for purchases.
-The subscriber is automatically enrolled in the green tier, then the subscriber can upgrade to the silver tier by spending 300 Saudi Riyals annually. If the subscriber spends 666 Saudi Riyals annually, they can further upgrade to tier.
EARNING Points
The rewards that are available to you through Barns Loyalty Program are based on the number of Points that you earn. You can earn Points by making purchases at participating Barns stores in the Kingdom of Saudi Arabia in the following ways:
Scanning your member QR code in the App and then paying with cash, credit card, debit card or mobile wallet
- The subscriber with a green tier will get Four point for every (10) riyals spent when purchasing drinks from Barns branches.
- The subscriber with the silver tier will get six points for every (10) riyals spent when purchasing drinks from Barns branches.
-The subscriber with the Glod tier will get seven points for every (10) riyals spent when purchasing drinks from Barns branches.
- The value of 10 points = (1) Saudi riyal.
- The subscriber earns points by purchasing food and beverages from Barnes' branches and kiosks.
- The subscriber is entitled to use the points only on beverages.
- Points expire within (12) months from the date of their acquisition.
We reserve the right to change or suspend the number and type of benefits offered to members of Barns Loyalty Program in our sole discretion at any time
OTHER IMPORTANT INFORMATION YOU SHOULD KNOW
When ordering through the application, subscribers cannot pay in cash; payment must be made only through electronic payment gateways.
There are no participation or tier fees associated with Barns Loyalty Program. Points accrued in connection with Barns Rewards are promotional, have no cash value and cannot be redeemed for cash. In addition, your redemption of Points accrued in connection with Barns Loyalty Programcannot be combined with any other offers or discounts, unless otherwise expressly indicated.
Your Points, Rewards and Barns Loyalty Program account are personal to you and may not be sold, transferred or assigned to, or shared with, family, friends or others, or used by you for any commercial purpose.
Without notice to you, we reserve the right to suspend any/or terminate your account and/or your participation in Barns Loyalty Program if we determine, in our sole discretion, that you have violated the Terms or that the use of your Barns Loyalty Program account is unauthorized, deceptive, fraudulent or otherwise unlawful. We may, in our sole discretion, suspend, cancel or combine your Barns Loyalty Program accounts that appear to be duplicative. In the event that your participation in your Barns Loyalty Program is terminated, all accrued Points in your account are void.
Without notice to you, we also reserve the right to "unregister" and make ineligible for your Barns Loyalty Program an account that has been inactive for one (1) year. Inactivity is defined as no Points earned during such one (1) year period. In the event that your account is unregistered or rendered inactive, all accrued Stars in your account are void.
We reserve the right to change, modify, discontinue or cancel your Barns Loyalty Program or any part of your Barns Loyalty Program, at any time and in our sole discretion, without notice to you.
These terms of use are produced in the Arabic and English languages. If there is any discrepancy between the Arabic and the English texts, the Arabic text prevails.
In our sole discretion, our rights and obligations under these terms of use may be assigned at any time and without any notice to you, and these terms of use shall remain binding on you and your respective executors, administrators, successors and representatives, should any assignment of these terms of use by us to another entity be made.
Liability
We expressly disclaim any liability with regard to access to or use of Barns Loyalty Program being uninterrupted or error-free. We do not represent or warrant that Stars will always be accepted or accessible.
You agree that we shall not be liable for any loss, damages or expenses whatsoever due to any failure due to events beyond our reasonable control, any system failure, failure to provide you with accurate information, our taking any action required by any regulators governmental, regulation or court order, our declining an authorization for any particular transaction, regardless of its reason, or any breach or violation of these terms of use by you.
To the maximum extent permitted by law, you agree to limit any claims for damages against us to monetary relief for the actual damages sustained by you as a direct result of any proven failure imputable to us, provided that such damages shall not exceed the last Points balance on your Barns Loyalty Program account at the time the imputed event occurred. You agree not to claim any indirect, special, consequential or punitive damages from us.
GOVERNING LAW AND DISPUTE RESOLUTION
Any dispute arising from these terms of use or your access to or participation in “Barns” loyalty Rewards program will be governed, construed, and enforced in accordance with the laws of the Kingdom of Saudi Arabia. Any dispute between the parties will be resolved exclusively by the competent courts in the city of Jeddah.
SEVERABILITY
If any provision or part of a provision of these terms of use is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these terms of use and does not affect the validity and enforceability of any remaining provisions.

by Barns, each of which is incorporated by reference and each of which may be updated by Barns from time to time without notice to you in accordance with the terms set out under the "Modification of Terms of Use" section below. In addition, some services offered through the Services may be subject to additional terms and conditions specified by Barns from time to time; your use of such services is subject to those additional terms and conditions, which are incorporated into these Terms of Use by this reference. These Terms of Use apply to all users of the Services.
Registration and Eligibility :
You may need to register for an account or use your credentials (e.g. username and password) to access some or all of our Services. If you register for an account with Barns, you shall provide Barns with accurate and complete registration information (including, but not limited to your email address and/or mobile telephone number and a password you will use to access the Service). You will also keep your registration information accurate and up-to-date.
You agree that you will not:
create an account for anyone other than yourself without such person's permission;
create a username that is the name of another person with the intent to impersonate that person;
create a user name or Barns account that is subject to any rights of a person other than you without appropriate authorization; or
create a user name that is a name that is otherwise offensive, vulgar or obscene or otherwise unlawful.
Barns reserves the right to refuse registration of, or cancel a username, in its sole discretion. You are solely responsible and liable for activity that occurs on your account and shall be responsible for maintaining the confidentiality of your Barns password. You shall never use another user's account without such other user's prior express permission. You will immediately notify Barns in writing of any unauthorized use of your account, or other account related security breach of which you are aware.
You must be at least 13 years of age to access of use the Services. If you are under 13 years of age (or the age of legal majority where you reside), you may only access or use the Services under the supervision of a parent of legal guardian who agrees to be bound by these Terms of Use. The Service is not available to individuals who are younger than 13 years old. Barns may, in its sole discretion, refuse to offer the Services to any person or entity and change its eligibility criteria at any time.
If you use a mobile device. In the event you change or deactivate your mobile telephone number, you agree that you will update your account information on the Services within 48 hours to ensure that your messages are not sent to the person who acquires your old number.
Privacy :
By using the Services, you consent to Barns collection, use, and disclosure of information about you and your device. Please refer to our Privacy Policy for information about how we collect, use and disclose information about you and your mobile device. Please review our data collection practices carefully before using our Services.
All Content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such Content. Barns cannot guarantee the authenticity of any Content or data which users may provide about themselves. You acknowledge that all Content accessed by you using the Service is at your own risk and you will be solely responsible and liable for any damage or loss to you or any other party resulting therefrom. For purposes of these Terms of Use, the term "Content" includes, without limitation, any location information, "shouts", videos, audio clips, comments, information, data, text, photographs, software, scripts, graphics, and interactive features generated, provided, or otherwise you make accessible to Barns on or through the Services. Content you add, create, upload, submit, distribute, post or otherwise.
Rules and Conduct. :
As a condition of your use, you shall not use the Services for any purpose that is prohibited by these Terms of Use. You are solely responsible for all of your activity in connection with the Services. Additionally, you shall abide by all applicable local, national and international laws and regulations and, if you represent a business, any advertising, marketing, privacy, or other self-regulatory code(s) applicable to your industry.
You shall not (and shall not permit any third party to), download, post, submit or otherwise distribute or facilitate distribution of any Content on or through our Services, including without limitation any User Submission, that:
infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any other person or entity or violates any law or contractual duty;
you know is false, misleading, untruthful or inaccurate;

nvolves commercial activities (whether or not for profit) and/or sales without Barns prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;
contains software viruses or any other computer codes, files, worms, logic bombs or programs that are designed or intended to disrupt, disable, damage, limit or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any system, data, password or other information of Barns or any third party;
impersonates any person or entity, including any employee or representative of Barns;
includes anyone's identification documents or sensitive information; or
breaches the Privacy Policy, or any of the other policies and rules incorporated herein.
If the User Submission includes a photograph, Barns Photo Guidelines shall apply.
Zero tolerance policy for indecent materials will result in immediate termination of any user account found distributing or publishing such content. Additionally, Barns will report such activities to the relevant authorities.
Don't take photos that include people's private information, like a credit card number or phone number, and don't upload a photo of anyone who doesn't want their picture uploaded
You shall not (directly or indirectly):
modify, adapt, appropriate, reproduce, distribute, translate, create derivative works or adaptations of, publicly display, republish, repurpose, sell, trade, or in any way exploit the Service or Site Content (other than your User Submissions), except as expressly authorized by Barns .
use the Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying our services or that could damage, disable, overburden, or impair the functioning of our services in any manner; otherwise take any action in violation of Barns guidelines and policies.
Barns does not guarantee that any Content or User Submission (as defined above) will be made available on the Site or through the Service. Barns has no obligation to monitor the Sites, Services, Content, or User Submissions. However, Barns reserves the right to (i) remove, suspend, edit or modify any Content in its sole discretion, including without limitation any User Submissions at any time, without notice to you and for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content or if Barns is concerned that you may have violated these Terms of Use), or for no reason at all and (ii) to remove, suspend or block any User Submissions from the Service. Barns also reserves the right to access, read, preserve, and disclose any information as Barns reasonably believes is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce these Terms of Use, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of Barns, its users and the public.
Card Services :
Certain features of our Services and/or certain services and products made available to you through the Services may allow you to purchase services (“Card Services”). Barns uses a third-party payment processor (the “Payment Processor”) to link your credit card account to the Services (your “Card Account”) for use of the Card Services. The processing of payments or credits, as applicable, in connection with the Card Services will be subject to the terms, conditions and privacy policies of the Payment Processor and your credit card issuer in addition to this Agreement. Barns is not responsible for any errors by the Payment Processor. In connection with your use of the Card Services, Barns will obtain certain transaction details, which Barns will use solely in accordance with our privacy policy .
Limitation of Liability :
All liability of Barns, its subsidiaries and affiliates, each of it and its directors, employees, agents, representatives, partners, suppliers or content providers arising for any loss suffered as a result of your use our sites, services, content, user submissions expressly excluded to the fullest extent permitted by law, except that if a court of competent jurisdiction determines that liability of barns, its directors, employees, agents, representatives, partners, suppliers or content providers (as applicable) has arisen.
Governing Law:
